- Care Close By does not automatically screen job seeker, employer and other's submissions.
- You are of legal age to work or you are in the legal position to hire an applicant listed on this site.
- You have read and understand the terms of this agreement.
- You agree to be bound by the terms of this agreement and terms that are periodically updated from time to time.
- Care Close By reserves the right to change, add or remove portions of these terms at any time. You may want to periodically check this page for any changes or modifications to the terms. If you see the terms posted
on this web site, you understand and agree that they are currently effective and are bound by all changes.
ACCEPTABLE SITE USE
General Rules for Employers and Recruiters
- Use of any password-protected area of the web site is restricted to the registered user(s) who have been given permission and a password to enter such area ONLY. This password cannot be distributed to others, and
the registered user is responsible for any and all damages to Care Close By resulting from the distribution of his or her password. You are responsible for maintaining the confidentiality of your information and
password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify Care Close By of any unauthorized use of your registration or password.
- You are only permitted to post ads for real jobs. Job postings must be individual openings for traditional, W-2 or 1099 employees.
- Postings that are defined as "work at home" or "Business opportunities" are not allowed. Exception is an individual who needs respite help or a home health aide.
- All information contained in postings must be clear and accurate, not misleading in any way, containing sufficient detail. Postings must contain enough information to allow a Job Seeker to make a reasonable informed
decision as to whether to apply or not apply.
- We cannot monitor every posting to Care Close By, nor do we take responsibility for the content posted by our users. However, we do randomly monitor postings to ensure compliance with these Terms and Conditions of
Use.
- Postings found to be in violation of any of the conditions may be removed without warning and the poster may be notified. Interpretation of the rules is at the sole discretion of Care Close By. Posting on Care Close
By is a privilege. Care Close By reserves the right to suspend that privilege on an individual basis for any reason. User waives all rights and remedies for a refund of fees paid if in it's sole discretion Care
Close By removes a posting for violating our posting terms and conditions.
- Care Close By does not tolerate unsolicited commercial email (SPAM). Care Close By users involved in such activity will have their accounts suspended, with no refund of remaining membership fees and Care Close By
will take any and all legal action at their disposal.
- Printing out or otherwise copying or using any personally identifiable information about candidates for purposes other than consideration of the candidates for potential employment by your company, in the case of an
employer, or for presentation to a client in the case of a search firm is strictly prohibited.
- If you are a search firm or third party recruiter you must obtain a candidate's consent prior to presenting said candidate to a potential employer.
It is your responsibility to conduct all necessary pre-hiring procedures.
- These may include, but is not limited to:
- Phone or email pre-interview
- Proper face-to-face interview
- Checking proper references
- Checking authenticity of resume and other documentation the applicant provides to you
- Criminal background study
- Any other appropriate hiring procedures.
PRIVACY OF MINORS Care Close By is not designed or intended to provide information or services for, or collect any information from, any children under the age of 13. People under the age of 18
should use this site only with the guidance of parents, teachers, and other responsible adults while online and should use caution in sending any personally identifying information through the Internet.
USE OF CONTENT
Care Close By grants you permission to use, copy and transmit an applicant's posted resume or content or employer's job opening or content as long as you:
- include the Care Close By logo and web site address;
- do not display the content for the purpose of your commercial benefit;
- do not use for any illegal activity;
- do not embarrass Care Close By, the employer or the applicant;
- do not use for any deceptive activity or
- any other wrongful activity.
You agree that you will indemnify, defend and hold harmless Care Close By, its officers, directors, employees, and agents from any and all losses, expenses, third party claims, liability, damages and any costs
(including, but not limited to, attorney's fees) due to the use of this service or your violation of these terms.
JOB SEEKERS
it is your responsibility to properly investigate the hiring company before you accept an interview and accept the position offered to you.
This may include, but is not limited to:
- Phone or email pre-interview
- Proper face-to-face interview
- Providing proper references and other documentation
- Having a detailed list of questions regarding the companies' policies, procedures and other expectations

24/7 AVAILABILITY
While we try to have this web site available 24/7, from time to time that may not be possible. Our server may be involved in periodic maintenance or upgrades. There may be a malfunction that is
completely out of our control. We are not responsible for any interruption or failure in the telecommunication or digital links, hackers, network attacks, network congestion or other failures. We will do everything
reasonably possible to minimize any disruption that may occur. Care Close By makes no reference to any warranty or guarantee as to the "uptime" of this site.
PROHIBITED SITE USE
In connection with your use of the Web Site, you will not:

- Register an e-mail address that you do not own or for which you do not have the express permission of the owner to register.
- Knowingly violate or attempt to violate the security of the Web Site, including, without limitation knowingly: accessing data not intended for such user or logging into a server or account that the user is not
authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; attempting to interfere with service to
any user, host or network, including, without limitation, submitting a virus or corrupted data to the Web Site, overloading, continuous posting of repetitive text, "flooding", "spamming",

COSTS ASSOCIATED WITH THE ENFORCEMENT OF THESE TERMS & CONDITIONS
The user further agrees to be responsible for all costs incurred by Care Close By in enforcing these Terms and Conditions. Such costs include, but are not limited to, Care Close By's reasonable attorneys' fees, all
litigation costs associated with the enforcement of these Terms and Conditions, all fees paid to experts in determining, proving and litigation any violation of these Terms and Conditions and any other costs incurred by
Care Close By in the enforcement of these Terms and Conditions.
TERMINATION
Care Close By reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your information from this Web Site and immediate termination of your registration
with or ability to access the Web Site and/or any other service provided to you by Care Close By, upon any breach by you of these Terms and Conditions or if Care Close By is unable to verify or authenticate any
information you submit to the Web Site registration with or ability to access the Web Site.
SURVIVAL
All of the above terms shall survive the termination of our service between you and Care Close By. You understand that termination of this service is not an exclusive remedy for Care Close By. These terms will
survive any termination
Any controversy or claim arising out of or relating to these Terms, or the breach of these Terms, shall be settled by binding, non-appealable arbitration administered in Minnesota, in accordance with the
American Arbitration Association Rules and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. These terms is governed by the laws of the United States and the State
of Minnesota, without regard to any conflict of laws provisions, and the parties agree that jurisdiction and venue shall be proper exclusively in Minnesota. In the event of any dispute, the prevailing party shall be
entitled to recovery of its reasonable attorneys' fees and costs. If any provision of these Terms is deemed unenforceable or invalid, it is to that extent to be deemed omitted, and the balance of the Terms shall remain
enforceable.
YOU UNDERSTAND THAT BY USING THIS SERVICE, YOU USE IT "AS IS." WE WILL DO EVERYTHING REASONABLY POSSIBLE TO MAINTAIN ACCEPTABLE PERFORMANCE OF THIS SERVICE.
IN NO WAY SHALL Care Close By OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER,
INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, INFORMATION, PROFITS OR BUSINESS INTERRUPTION ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR PERFORMANCE OF THIS LISTING SERVICE, TO ANY INFORMATION,
PRODUCT OR ANYTHING ELSE OBTAINED THROUGH THE ACCESS OR USE OF THIS ONLINE SERVICE, OR TO THE INABILITY TO USE THE ONLINE SERVICE, WHETHER BASED IN TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF Care
Close By HAS BEEN ADVISED OF THE POSSIBILITY OR EXISTENCE OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE JOB LISTING SERVICE, AND RECEIVE A REFUND, IF ANY, OF ANY OUTSTANDING ACCOUNT
BALANCES.
Care Close By does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on
material posted by other users will be at your own risk.
We reserve the right to deny services to anyone for any reason.

not to say when a perspective employer contacts you.
Care Close By reserves the right to periodically review this information and make changes at any time. We highly recommend that you review this information from time to time.
